Wiking Helikopter Service plunges into administration

The German offshore transport specialist Wiking Helikopter Service has entered administration due to rising fuel costs, loss-making contracts and the lingering effects of the coronavirus pandemic. The company based in Sande was placed into administration on 15 June. Dr Christian Kaufmann was appointed as insolvency practitioner and takes part in negotiations.

In this chapter we will examine this in relation to a specific case, the Niki Luftfahrt GmbH insolvency proceedings. What makes this case notable is that the German preliminary administrator tried to change the centre of main interest (COMI) by only argumentation and interpretations of facts, so without relocation of the registered office or the transfer of assets.
