Download as PDFHaving already implemented an initial partial measure covering gynaecology and obstetrics services, insolvency administrator Mr Steffen Beck from PLUTA Rechtsanwalts GmbH has now developed an overall solution for the Friedrichshafen and Tettnang healthcare centres. Within the context of an insolvency plan solution, Oberschwabenklinik gGmbH is set to become the new owner of both centres and take over their ongoing operations from 1 January 2026. This will ensure the continued provision of medical care.
The insolvency administrator has concluded a framework agreement with Oberschwabenklinik gGmbH to this effect. The healthcare centres will continue to operate from their current premises and will retain the various statutory health insurance contracts. The implementation of the solution is still subject to the creditors’ approval.
Operations maintained for the past five months
On 28 May 2025, the Local Court of Ravensburg ordered provisional insolvency administration for the assets of Medizinisches Versorgungszentrum GmbH at Friedrichshafen Hospital and for Medizinisches Versorgungszentrum Tettnang GmbH. It appointed Mr Steffen Beck from PLUTA as provisional administrator for both insolvency proceedings for the healthcare centres operated by Medizin Campus Bodensee (MCB). These proceedings were opened as planned on 1 August 2025. Only the Friedrichshafen and Tettnang healthcare centres are involved. The associated hospitals are not part of the proceedings.
Mr Steffen Beck has been working with attorney Mr Florian Schiller to keep both healthcare centres operational since the applications were filed. They have ensured the provision of medical services during both the provisional and regular proceedings. Outpatient appointments and treatments have gone ahead as usual. In parallel over the past few months, the PLUTA restructuring experts have conducted the structured process of securing an investor with a view to finding a long-term solution. The insolvency administrator will keep both companies operating until the end of the year, at which point responsibility for them will pass to Oberschwabenklinik gGmbH.
The PLUTA team supporting the proceedings also comprises attorneys Dr Karl-Friedrich Gulbins, Mr Markus Fünning and Ms Susanna Schmollinger, who are involved in all contractual issues, as well as Mr Nikolaus Röver for the implementation of the M&A process, which is being assisted by experts Mr Gerrit Haug and Mr Levin Kunkel from WMCF GmbH based in Munich.
The detailed implementation of the solution is still being finalised. The insolvency administrator has already informed the staff at the healthcare centres about the latest developments. As soon as further details are confirmed, the insolvency administrator and Oberschwabenklinik gGmbH will make them public.
The PLUTA team will draw up insolvency plans for both companies and submit them to the court in the coming weeks so that the solution can be implemented with legal effect. The creditors will then have to vote on these plans in a discussion and voting meeting. If the plans are approved by a majority of the creditors, both companies will have been fully restructured. The first creditors’ assemblies in both proceedings were already held yesterday, with the insolvency administrator providing information on the current situation and the next steps. Both companies will be preserved under the insolvency plan solution. This planned restructuring is needed because the various statutory health insurance contracts are tied to the respective legal entity.

If the creditors give their approval, both healthcare centres will have been restructured and can commence operating independently again.”
