PLUTA attorney Dr Christian Kaufmann obtains unanimous approval for Diakonie Altenhilfe Bremerhaven gGmbH insolvency plan

The insolvency proceedings for Diakonie Altenhilfe Bremerhaven gGmbH are nearing a successful completion: at yesterday’s discussion and voting meeting, the creditors approved the insolvency plan presented by insolvency administrator Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH. Dr Christian Kaufmann welcomed the outcome: “There was 100% approval for the insolvency plan across all creditor groups. This important development now paves the way for the termination of the insolvency proceedings.”

The insolvency plan has laid the groundwork needed to put this non-profit company on a sustainable footing and maintain its operations outside the insolvency proceedings.”

Insolvency plan lays the groundwork for continuation

A crucial step has been reached in the proceedings with the approval. Once the court confirms the plan and the other requirements have been met, it will be possible to terminate the insolvency proceedings. Diakonie Altenhilfe Bremerhaven gGmbH will then be able to exit the insolvency proceedings on the basis of the provisions set out in the insolvency plan and focus as usual on providing high-quality care to the people in need of its services.

In particular, the insolvency plan establishes how creditors’ claims will be satisfied and the company will be financially restructured. Diakonie Altenhilfe Bremerhaven gGmbH filed for insolvency due to financial difficulties. In late January 2026, the Local Court of Bremerhaven ordered provisional insolvency administration and appointed Dr Christian Kaufmann as provisional administrator. On 1 April 2026, the insolvency proceedings were opened and the attorney was appointed regular administrator. The PLUTA restructuring team also comprises attorneys Mr Ingo Thurm and Ms Christine Behrens as well as economist Mr Jürgen Schendel.

The company provides services for older people and initially continued to run Jacobi-Haus and Elisabeth-Haus, two residential care homes in Bremerhaven. In March, the facilities were merged as a key restructuring measure: residents and staff from Jacobi-Haus in Lehe were transferred to Elisabeth-Haus in Geestemünde. The move went smoothly, and Elisabeth-Haus is now at full capacity with 120 residents.

Dr Kaufmann and his team have kept the business operating for around eight months during the proceedings to ensure continuity of care for the residents and service users while working on a long-term solution for the company.
