Download as PDFInsolvency administrator Mr Steffen Beck from PLUTA Rechtsanwalts GmbH has announced positive news for the Friedrichshafen and Tettnang healthcare centres: the creditors unanimously approved the respective insolvency plans last Friday. This means the decisive final hurdle has been cleared in both insolvency proceedings, which will be terminated at the end of the year. The healthcare centres will be able to make a fresh start at the beginning of 2026 as planned.
As envisaged in the insolvency plan solutions, Oberschwabenklinik gGmbH is set to become the new owner of both healthcare centres and take over their ongoing operations from 1 January 2026. This will ensure the continued provision of medical care. The insolvency administrator had already concluded a framework agreement with Oberschwabenklinik gGmbH to this effect back in October 2025. The healthcare centres will continue to operate from their current premises and will retain the various statutory health insurance contracts.
Over recent weeks, the PLUTA team drew up insolvency plans for both companies that set out the agreed solution. The creditors have unanimously approved these in both discussion and voting meetings. Both companies will be preserved under the insolvency plan solutions. This planned restructuring is needed because the various statutory health insurance contracts are tied to the respective legal entity.
The creditors will also benefit from this outcome: the insolvency administrator expects to achieve a recovery rate of at least 50% in the proceedings for Medizinisches Versorgungszentrum GmbH at Friedrichshafen Hospital. For MVZ Tettnang GmbH, the recovery rate will even be at least 80%. Insolvency recovery rates tend to be in the mid-single-digit range on average.
PLUTA partner Mr Steffen Beck said, “This is great news for staff and patients. We have achieved a long-term solution for the centres that will enable them to continue operating independently. And the creditors will receive a higher-than-average dividend, which was not expected at the outset of the proceedings.”
Operations successfully maintained
On 28 May 2025, the Local Court of Ravensburg ordered provisional insolvency administration for the assets of Medizinisches Versorgungszentrum GmbH at Friedrichshafen Hospital and for MVZ Tettnang GmbH. It appointed Mr Steffen Beck from PLUTA as provisional administrator in both proceedings. On 1 August 2025, regular insolvency proceedings for both healthcare centres operated by Medizin Campus Bodensee (MCB) were opened as planned. Only the Friedrichshafen and Tettnang healthcare centres are involved. The associated hospitals are not part of the proceedings.
Mr Steffen Beck and attorney Mr Florian Schiller will continue to run both healthcare centres until the end of 2025. The provision of medical services has been ensured over the past six months, despite the insolvency. In parallel to this, the PLUTA restructuring experts have conducted a structured process of finding an investor. Responsibility will now pass to Oberschwabenklinik gGmbH at the turn of the year.
The PLUTA team also comprised attorneys Dr Karl-Friedrich Gulbins, Mr Markus Fünning and Ms Susanna Schmollinger, who were involved in all contractual issues, as well as Mr Nikolaus Röver for the implementation of the M&A process, which was assisted by experts Mr Gerrit Haug and Mr Levin Kunkel from WMCF GmbH based in Munich.
