PLUTA attorney Peter Roeger finds partial solution for care provider Kissinger Sonne

Following a months-long process aimed at finding an investor, restructuring expert Mr Peter Roeger from PLUTA Rechtsanwalts GmbH has achieved a partial solution for care provider Kissinger Sonne. This will ensure continued care for more than 120 patients, almost three-quarters of all patients of Kissinger Sonne GmbH & Co. KG.

Cura Saale GmbH based in Bad Kissingen is to acquire the company’s outpatient care business by way of an asset deal and will keep on all of the employees most recently employed in this area. The relevant parties have signed the purchase agreement with effect from 1 July 2023.

Despite numerous negotiations with interested parties, it has not been possible to find a solution for the day care or community residential facility business. Most recently, the company had around 40 day care patients. Kissinger Sonne can continue to offer its day care services until 30 June. However, the team under the provisional insolvency administrator has been able to conclude an agreement with a day care facility in the immediate vicinity of Bad Kissingen, which has agreed to provide continued seamless care to the patients concerned. This will ensure a smooth transition in the interests of these clients.

Five senior citizens live in the community residential facility. Discussions regarding the possibility of transferring the leases are already ongoing. The senior citizens will also be able to avail themselves of the care services offered by the new operator from 1 July. Unfortunately, the employees engaged in the day care business and community residential facility will have to be let go. All staff at Kissinger Sonne and all patients have been or are being informed at this time about the changes.

Best possible outcome achieved

PLUTA attorney Mr Roeger said, “We have kept the care provider fully operational over the past five months. The priority has always been the welfare of the patients and clients and ensuring they receive good care. It would not have been possible to achieve a solution without the tireless efforts of all involved.”

“The solution now found with Cura Saale secures the care of the vast majority of the patients and clients. We have therefore achieved the best possible outcome. Unfortunately, it has not been possible to find a similar solution for the two smaller business areas, as the last remaining investor for these two segments could not meet the eligibility requirements set out in the German Social Security Code within the necessary timescale,” said Mr Roeger. He is being supported in the proceedings by business lawyer Mr Robert Schweinshaut and others.

Care services in Bad Kissingen and Schweinfurt

Kissinger Sonne GmbH & Co. KG based in Bad Kissingen filed for insolvency in late January 2023. On 1 February 2023, the Local Court of Schweinfurt then ordered provisional insolvency proceedings for the company’s assets and appointed Mr Peter Roeger as provisional administrator. The company had to file for insolvency due to liquidity problems.

Kissinger Sonne has been offering professional care, support and assistance in day-to-day life in Bad Kissingen and its surroundings as well as in Schweinfurt for over 20 years. Services include outpatient care, day care and a community residential facility providing round-the-clock short-term and long-term support for people in need of assistance.
