PLUTA attorney Heike Metzger appointed provisional administrator for tour operator We-Flytour

29 November 2024 · Heilbronn · Business Area Insolvency Administration

The Local Court of Heilbronn ordered provisional insolvency administration for the assets of We-Flytour GmbH and appointed Ms Heike Metzger from PLUTA Rechtsanwalts GmbH as provisional administrator on 27 November 2024.

The restructuring expert is currently working with her team to gain an overview of the situation. Over the coming days, she will in particular review the possibility of keeping the Heilbronn-based travel business operating.

As already communicated by the German Travel Insurance Fund (DRSF) on its website, the company has cancelled all trips not yet commenced with a departure date up to and including 10 December 2024. Some 1,500 travellers already at their holiday destinations, mainly Turkey and Egypt, are also affected.

Customers advised not to cancel their trips

Trips booked for 11 December 2024 and later have not yet been cancelled. All stakeholders are reviewing whether these can go ahead. The provisional insolvency administrator is in discussions and We-Flytour will move swiftly to update those due to travel as soon as a decision has been taken. It is not currently possible to book new trips.

Ms Heike Metzger from PLUTA said, “We have held initial discussions and are determining whether trips booked for 11 December and later can go ahead. The tour operator will let customers know as quickly as possible.” The provisional insolvency administrator has advised customers not to cancel their bookings themselves as they would then incur cancellation fees.

We-Flytour has a staff of 18 employees, whose salaries are guaranteed for a period of three months thanks to specific substitute benefits provided under German insolvency law. The restructuring expert will also arrange the pre-financing of the insolvency substitute benefits as soon as possible.

PLUTA has extensive experience in managing insolvency cases in the tourism industry. For example, the restructuring company’s attorneys have been involved in the insolvency proceedings for JT Touristik, nicko cruises, Glückskäfer Reisen, the H&H Touristik Group and more. Ms Heike Metzger is being supported in the proceedings by attorney Mr Heinz-Joachim Hombach.
