PLUTA attorney Dr Uwe Paul appointed provisional administrator for KYTO Coffee GmbH and KYTO Roastery GmbH

By order dated 2 June 2025, the Local Court of Düsseldorf ordered provisional insolvency administration for the assets of KYTO Coffee GmbH and KYTO Roastery GmbH. The court has appointed attorney Dr Uwe Paul from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for both companies.

KYTO Coffee GmbH operates one café in Düsseldorf and another in Wuppertal offering speciality coffee produced by KYTO Roastery GmbH (in its own coffee roastery) and others.

The two companies currently employ almost 30 people. Their salaries are guaranteed for a period of three months thanks to specific substitute benefits provided under German insolvency law. The provisional insolvency administrator is currently engaging with the Federal Employment Agency to secure approval for the pre-financing of these benefits for the employees.

Dr Uwe Paul is in the process of gaining a comprehensive overview of the financial situation of both companies. His aim is to stabilise their day-to-day operations and to find continuation solutions for both of KYTO Coffee GmbH’s locations and for KYTO Roastery GmbH. Early in 2025, he already succeeded in similar efforts on behalf of KYTO Coffee & Deli GmbH, another company within the KYTO Group. An asset deal was implemented for this insolvent company and all jobs were preserved.

Attorney Mr Oliver Westkamp from the PLUTA team is assisting attorney Dr Uwe Paul with business continuity measures during the provisional proceedings.
