Insolvency proceedings opened: PLUTA attorney Georg Jakob Stemshorn continues restructuring of sports club Post SV Augsburg e.V.

On 1 May 2025, the Local Court of Augsburg (insolvency court) opened insolvency proceedings for the assets of Post SV Augsburg e.V. and appointed Mr Georg Jakob Stemshorn from PLUTA Rechtsanwalts GmbH as regular administrator. He had previously acted as provisional administrator since the application for insolvency was filed in February 2025. An important milestone has therefore been reached in the continuation and sustainable restructuring of the recreational sports club. All sports activities are running as usual, and the 14 employees and 33 trainers remain committed.

“The sports club’s restructuring is proceeding as planned,” said insolvency administrator Mr Georg Jakob Stemshorn. In particular, the PLUTA restructuring expert welcomed the support of all involved. “We are holding constructive discussions and have worked out various courses of action designed to put the club on a viable footing. We are particularly pleased to have the broad support of the creditors holding a lien on the club’s property – thanks to their contribution to the insolvency estate, the club is managing to cover its costs.”

Potential investors already submitted initial offers in the provisional proceedings under a structured process of finding an investor. These will now be comprehensively reviewed.

Long-term financial stability the goal

“We have been able to consistently pursue the path we’ve embarked on thanks to the constructive cooperation with all involved, especially the management board and its newly elected members, the advisory board and the financing creditors. Our goal remains to ensure the club’s long-term financial stability within the context of an insolvency plan,” said Mr Stemshorn. The PLUTA team is comprised of Ms Martina Kaderabek, business lawyers Ms Anna Beck, Mr Maximilian König and Ms Marina Weber and law graduate Ms Maralen Peischer.

Over the coming weeks, the team will focus on further developing the insolvency plan and continuing the discussions with investors and partners. The aim remains to provide the club with a long-term and stable outlook. Now that the proceedings have been opened, creditors may file their claims for inclusion in the insolvency schedule. These will then be reviewed by the insolvency administrator.

Mr Heinz Krötz, president of Post SV Augsburg e.V., emphasised, “The opening of the proceedings gives us the certainty we need to set a course for our club’s long-term future together with the insolvency administrator. We would like to thank all members, employees and partners for their loyalty and trust.”

The Augsburg-based sports club elected a new management board in April. Dr Sonja Rapp, a doctor of law and owner of an eponymous tax firm, and Ms Tatjana Dörfler, a member of the city council, are now club vice-presidents. Mr Dirk Wurm, previously sports officer for the city of Augsburg, was also appointed to the board as an additional vice-president.

Furthermore, the assembly of delegates confirmed Mr Rudolf Otto Reisch and Mr Thomas Schnörzinger in their positions as committee members. The election of Mr Dirk Wurm and Mr Rudolf Reisch to the board made it necessary to appoint a new member to the club’s advisory board – Mr Reinhold Demel, former head of the Federal Employment Agency in Augsburg, has therefore joined.

Sports and events are still going ahead as usual.
