By a decision taken on 7 May 2025, the Local Court of Fürth ordered provisional insolvency administration for the assets of dataform dialogservices GmbH. The court has appointed attorney Mr Patrick Meyerle from PLUTA Rechtsanwalts GmbH’s Nuremberg office as provisional administrator.

dataform based in Roßtal has established a good market position in recent years as a provider of dialogue marketing and e-commerce fulfilment services. The unexpected withdrawal of a promised shareholder loan resulted in a funding gap that it could not bridge at short notice, despite its confirmed orders. It was therefore left with no choice but to file for insolvency. Given its good order situation, dataform will continue to operate as normal in coordination with the provisional administrator.

The company has advanced technical equipment and long-established customer relationships in the B2B segment. The aim of the provisional proceedings is to keep the business operating as normal and build the financial framework for a long-term solution.

Discussions ongoing with interested parties

Provisional insolvency administrator Mr Patrick Meyerle is working with management on a financially viable continuation strategy. Focused engagement with potential investors is a key step in this regard.

“We want to preserve the business. The conditions for this are in place. Even at this very early stage in the proceedings, we have already been contacted by initial interested parties. We will conduct a detailed analysis of the company’s financial position over the coming weeks, review all restructuring options and launch a structured process aimed at finding an investor. The initial conditions are therefore more than favourable,” said attorney Mr Patrick Meyerle. His PLUTA restructuring team also includes business lawyer Mr Holger Christian Buehler and attorney Ms Jacqueline Tilberis.

Business operations continuing

The company’s operations will carry on as normal while the provisional insolvency administration is underway. The wages and salaries of the almost 230 employees are guaranteed for the duration of the provisional proceedings thanks to specific substitute benefits provided under German insolvency law. Mr Patrick Meyerle and management updated the employees on the latest situation during a staff meeting.

The execution of dialogue marketing activities, the delivery of digital print products and the provision of fulfilment services based on existing orders and contracts are ensured. Orders may be placed with the relevant inside and outside sales staff at any time. Discussions to coordinate the continuation of the business will soon be held with suppliers and customers.

dataform managing director Mr Klaus Vollmer is grateful to the employees for their commitment. The initial discussions with business partners have also been very constructive. He said, “We believe that we will find a long-term solution during the course of these proceedings. Our customers and suppliers have validated this assessment with their initial positive response, and we would like to thank them for their support.”
