In the restructuring proceedings for hospital operator Ketteler Krankenhaus gemeinnützige GmbH, all creditor groups approved the insolvency plan at the discussion and voting meeting held last Friday. The team of PLUTA restructuring experts led by Mr Philip Konen and Dr Christian Kaufmann has therefore succeeded in developing and delivering an effective solution for the hospital within a short space of time.
The creditors’ approval marks a major milestone in the company’s debtor-in-possession proceedings. Once the insolvency plan has been approved by the court and becomes final and binding in law, it will be possible to terminate the proceedings soon after that. This therefore secures the hospital’s future. The jobs of the more than 900 employees have been saved and the continued provision of high-quality medical care in the Frankfurt/Offenbach region is ensured.
PLUTA restructuring experts secure long-term prospects
The operator of the Ketteler hospital initiated debtor-in-possession restructuring proceedings in autumn 2025. The aim of this was to establish a durable financial foundation and secure long-term prospects for the site. Restructuring experts Mr Philip Konen and Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH have supported management since then in their capacity as general agents for the hospital. The PLUTA team also comprises attorneys Mr Philipp Meyer, Mr Sebastian Weyland and Mr Alexander Bortfeldt as well as Mr Sven Arnstadt, business management expert Mr Ludwig Stern and business lawyer Ms Celine Plaschke. Industry expert Mr Dietmar Eine (Hospital Management Group GmbH) is acting as chief restructuring officer.
Those in charge have kept the hospital operating since the insolvency application, ensuring that patients would continue to be treated and receive high-quality care at all times. The insolvency plan now provides for debt relief for the company and lays the groundwork for Deutsche Rote Kreuz Kreisverband Offenbach e.V., the German Red Cross (GRC) district association in Offenbach, to become the operator of the hospital. This transition will take place once the proceedings have been concluded. The Ketteler hospital will remain not-for-profit going forward.

General agent Mr Philip Konen, a restructuring expert at PLUTA Rechtsanwalts GmbH, said, “The approval from all of the creditor groups shows that we have devised a viable and balanced solution. This clears the way for the hospital’s continued operation on a sustainable basis.”
Within around four weeks of the insolvency plan becoming final and binding in law, an initial interim dividend of an expected approximately 8.7% will be distributed to the creditors. PLUTA attorney Dr Christian Kaufmann added, “This result has been enabled by the constructive and swift cooperation of all stakeholders. We would like to express our sincere thanks for this.”
Insolvency monitor Dr Lason Gutsche has also welcomed the outcome of the voting meeting: “The creditors’ unanimous approval has enabled a solution that has secured the hospital’s long-term future while ensuring the creditors’ claims are satisfied to the greatest extent possible.”
