PLUTA restructuring expert Sebastian Laboga ensures a future for technology of aviation company APUS Zero Emission

Mr Sebastian Laboga from PLUTA Rechtsanwalts GmbH had good news to announce for APUS Zero Emission GmbH: in the past week, the creditors in the insolvency proceedings have unanimously approved the recovery plan drawn up by him in his capacity as administrator. This means that the follow-up solution can be implemented effective 1 May 2025. FTI Engineering Network GmbH, a subsidiary of peiker Holding GmbH, is significantly expanding its capacities and service offering by way of an asset deal with APUS Zero Emission GmbH. All of the aviation company’s employees – most recently 44 – will be retained.

“Our goal was to achieve an economically sound and viable outcome that would be in the interests of the creditors. The solution we have now found will not only secure the business operations, but also safeguard the know-how and jobs. The approval of the creditors’ assembly validates our chosen course of action,” said attorney Mr Laboga.

Workable agreement in the interests of the creditors

APUS Zero Emission GmbH based in Strausberg near Berlin is an innovative developer in the aviation industry. The company specialises in the design, certification and integration of modern aviation systems.

APUS filed for insolvency with the Local Court of Frankfurt (Oder) in March 2025. The insolvency proceedings were opened on 1 May 2025, and Mr Sebastian Laboga was appointed insolvency administrator. He had previously acted as provisional administrator for the company. The PLUTA team comprising attorneys Mr Sebastian Laboga, Mr Michael Bohnhoff and Mr Tillman de Vries (contract negotiations) had kept the business running since the application was filed. Together, they worked hard to achieve a sustainable solution.

They conducted the process of finding an investor and spoke with several interested parties. This can now be concluded in close consultation with the investors and the creditors thanks to a workable agreement having been reached. The insolvency administrator and his team are pursuing separate solutions for the APUS i-2 (hydrogen-powered light aircraft) and APUS i-5 (regional aircraft with a sustainable propulsion concept) projects.
