Download as PDFDr Christian Kaufmann from PLUTA Rechtsanwalts GmbH has announced positive news for creditors of Ekowep GmbH & Co. KG, a biogas plant operator based in Ostrhauderfehn in the Leer district: the insolvency administrator has achieved a recovery rate of 100% in the proceedings. He can therefore fully satisfy all filed insolvency claims within the meaning of section 38 of the German Insolvency Code (InsO).
Dr Christian Kaufmann said, “This is an exceptional outcome for the creditors. We have only been able to achieve this rate thanks to the close cooperation and efforts of all involved.”
The high rate is due to good realisation proceeds and the successful enforcement of legal claims, through which the administrator increased the insolvency estate for the creditors.
Ekowep GmbH & Co. KG operated a biogas facility. Its core business consisted of building and running a dry fermentation plant. The electrical energy generated there was sold to the relevant utility company. The plant also supplied energy to a cooperative in the region.
In summer 2020, the Local Court of Leer opened insolvency proceedings for the assets of Ekowep GmbH & Co. KG and appointed Dr Christian Kaufmann as insolvency administrator.
