Download as PDFAttorney Mr Sebastian Scheuer from law firm Stellmach & Bröckers, acting on behalf of the board of Lebenshilfe Bocholt-Rhede-Isselburg e.V. and management at Lebenshilfe Bocholt Wohnen gemeinnützige GmbH in his capacity as general agent, has applied to the Local Court of Münster for the opening of debtor-in-possession insolvency proceedings. The court has approved the applications and appointed Dr Ria Brüninghoff from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor to protect the interests of the overall body of creditors in both proceedings.
“Lebenshilfe’s cost structure is unbalanced, with expenses outstripping revenues despite pandemic-related one-off effects,” explained the general agent. “We are optimistic about the prospects for an operational restructuring. People with disabilities and their relatives and carers will still have the same points of contact during the debtor-in-possession insolvency proceedings. The association is continuing to pursue its activities and provide support services.”
The team, which is tasked with continuing to draw up and implement a plan for the restructuring, already established communication with the North Rhine-Westphalia offshoot of Deutscher Paritätischer Wohlfahrtsverband e.V., an association of social movements, and that association’s own consulting firm in advance of filing the applications for insolvency.
Lebenshilfe Bocholt Wohnen gGmbH employs around 100 people and five trainees, who support and care for people with intellectual and multiple disabilities in Bocholt. The company provides social inclusion services in particular for 54 residents of six community residential facilities by means of a special form of residential arrangement at locations in Pendeweg, Werther Strasse and Dinxperloer Strasse.
Founded in 1964, Lebenshilfe Bocholt-Rhede-Isselburg e.V. represents the interests of its members with and without a disability. The association is continuing to provide educational, school support, sports and leisure offerings for people in the region.
