Follow-up solution for vacuum specialist Meßner

12 March 2024 · Munich, Germany · Business Area Restructuring

A follow-up solution has been achieved under the debtor-in-possession proceedings for Meßner GmbH & Co. KG based in the East Westphalia-Lippe region. Newly founded Meßner Produktions GmbH & Co. KG has acquired the business operations and the some 40 employees effective 1 March 2024. The site has also been saved. The restructuring team has therefore found the best possible solution for the long-standing company. The creditors’ assembly unanimously approved the sale in the past week.

Since early October 2023, Meßner had been involved in debtor-in-possession restructuring proceedings, where management remains in charge and guides the company in question through the proceedings itself. Attorney Mr Philip Konen and business management expert Mr Ludwig Stern from PLUTA Rechtsanwalts GmbH had been acting as general agents and were responsible for implementing the restructuring measures. They were assisted in this by attorney Ms Kristina Breuer. Attorney Mr Martin Schmidt from law firm AndresPartner was appointed insolvency monitor and was overseeing the proceedings in the interests of creditors.

Best possible outcome achieved

With this follow-up solution, siblings Ms Claudia Meßner and Mr Michael Meßner will continue to serve as managing directors of the family business going forward. Meßner was founded in 1970 and operates in both the vacuum technology and water garden technology business segments. It is synonymous with high-quality, German-made products.

Managing director Ms Claudia Meßner said, “My brother and I are pleased that it has been possible to achieve this follow-up solution. We would like to thank all involved, especially our motivated staff and loyal customers, without whom this successful outcome would not have been possible.”

The vacuum specialist continued operating over recent months. Customers received their deliveries as usual and orders were fulfilled. The staff also backed the restructuring process. A restructuring concept designed to ensure the long-standing company’s future viability was implemented over the past few months. In the future, Meßner will focus on profitable core products in the two divisions. With the Meßner siblings remaining on board, management’s expertise and extensive network will be retained. This is of great importance to the vacuum specialist’s successful future.

PLUTA attorney Mr Philip Konen said, “The future looks bright for the Meßner company. We have taken important restructuring steps over recent months that will allow the company to make a fresh start.”

Attorney Mr Martin Schmidt said, “I welcome the investor solution that has now been achieved, as this represents the best possible outcome for the business and creditors. Debtor-in-possession proceedings have proven to be a suitable instrument for Meßner’s repositioning.”
