Download as PDFConcept Maschinenbau GmbH, which acquired the business of the insolvent Kiener Maschinenbau GmbH in 2023, has initiated (provisional) debtor-in-possession insolvency proceedings before the competent court.
The company is not involved in regular insolvency proceedings and an insolvency administrator has not been appointed. Management retains its powers of disposition and is responsible for day-to-day operations. Attorney Dr Matthias Lehr from PLUTA Rechtsanwalts GmbH is supporting the restructuring as (provisional) insolvency monitor in the interests of the creditors.
The application has been filed due to a public sector body’s surprising decision to enforce legal claims against Concept Maschinenbau GmbH, which stem from the acquisition in 2023 and are directed at the insolvent Kiener Maschinenbau GmbH (in liquidation).
At the time of acquisition and thereafter, these claims were never deemed to be part of the transaction and were therefore not considered in the business plans (earnings, financial headroom).
Management is optimistic that the company can be sustainably restructured. The key operating numbers indicate very good business momentum. The company reported a positive financial result in 2024. The first six months of 2025 show solid profitability, and figures were significantly better than planned across all key metrics.
Concept Maschinenbau GmbH currently employs around 180 people. It specialises in automation solutions in the area of special machine construction. Together with customers, suppliers and staff, the task now is to do everything necessary to fulfil existing orders (mainly from the automotive and defence industries) as planned. With its strong network of specialists and manufacturers, it can offer custom solutions for efficiency gains, automation and process optimisation.
Vrades Systems & Technologies GmbH, an independent entity also operating at the Lauchheim site, is not affected by the proceedings.
