Download as PDFBüroring eG is now pursuing its ongoing restructuring within an orderly legal framework: on 4 September 2026, the Local Court of Wuppertal ordered provisional debtor-in-possession proceedings after the cooperative had filed the relevant application.
The restructuring experts at law firm ATN Rechtsanwälte are assisting the management board in this. The court has appointed attorney Mr Christoph Chrobok from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor. He is supporting the proceedings in his legally mandated independent capacity.
Back on 27 August 2026, the Büroring eG supervisory board had invited its members to an extraordinary general meeting to inform them about the company’s strained liquidity position and the possible economic and legal courses of action. Among other things, the wide-ranging structural changes of recent months had led to this situation. A short-term liquidity shortfall was the immediate cause for the management board’s decision to pursue the subsequent steps under debtor-in-possession proceedings.
Business operations to continue without restriction
For members, affiliated specialist retailers and suppliers, the key message is: Büroring eG’s business operations are being maintained without restriction. Management board members Mr Ingo Dewitz and Mr Björn Unfug retain full operational responsibility and are continuing to lead the company together with experienced restructuring experts.
Attorney Dr Marc d’Avoine from ATN Rechtsanwälte, as general agent, and his team are helping the management board to implement the next steps and conclude the restructuring. His initial assessment is positive:
“Büroring eG has sound structures and established workflows that are conducive to it restructuring as a debtor in possession. Funding for the business is secured. The key structural changes have been implemented, and we are targeting the completion of the restructuring in the first quarter of 2027.”
Restructuring already well advanced
Important elements of the operational restructuring had already been implemented or were well advanced at the time the company filed for insolvency. These include considerable cost reductions, organisational adjustments, the realignment of logistics and the strategic development of the services offered to members and affiliated specialist retailers. The debtor-in-possession proceedings now provide the legal framework under which the process already set in motion can be brought to a successful conclusion.
The aim of the debtor-in-possession proceedings is to stabilise Büroring eG’s situation for the long term and secure its future. The cooperative is working with restructuring experts, members, suppliers and major business partners on overcoming the remaining operational challenges, with a view to successfully concluding the restructuring in the first quarter of 2027.
