Successful restructuring: PLUTA attorney Sebastian Laboga achieves solution for airport service provider ESA Luftsicherheit & Service GmbH

The future of ESA Luftsicherheit & Service GmbH has been secured: insolvency administrator Mr Sebastian Laboga from PLUTA Rechtsanwalts GmbH has succeeded in finding an investor, who will acquire the business effective 15 February 2025. All some 50 jobs have been saved and the provider’s operations will be seamlessly continued.

“In challenging proceedings and under a great deal of time pressure, we have managed to find a sustainable solution that will ensure the business continues operating. This is welcome news for the staff, clients and passengers. It also means we have achieved the best possible outcome for the creditors,” explained insolvency administrator Mr Laboga. The specialist attorney is being supported in the PLUTA team by attorney Mr Nicolas Konkel.

Business continuity

Customers can rest assured of seamless business continuity through the new company: there will be no disruption to the activities at the airports in Lübeck, Kiel, Sylt, Rostock and Heringsdorf.

The company, which is part of the ESA Group, filed for insolvency in late January 2025. The Local Court of Charlottenburg opened the insolvency proceedings on 15 February 2025 and appointed Mr Sebastian Laboga as administrator. Mr Laboga and his team have held numerous discussions in recent days aimed at giving the business a viable future. Its activities continued in the meantime, ensuring seamless operations at the airports.

The buyer that has now been found not only brings with it the necessary expertise but will also keep on all employees. “All of the jobs have been saved, and that is a really good outcome. I am delighted for the employees, who have shown full commitment despite the insolvency,” continued the PLUTA attorney. The PLUTA team also moved very swiftly to organise pre-financing of the specific substitute benefits provided under German insolvency law so that the employees could receive their outstanding wages and salaries. Mr Laboga added, “Thanks to the intensive collaboration of all stakeholders, we have been able to achieve a solution within a matter of days that provides stability and will allow passengers travelling through the airports to plan with certainty.”
