PLUTA attorney Dr Wehner secures future of temporary employment agency based in Porta Westfalica

Good news in the insolvency proceedings for temporary employment agency SUNTEC GmbH Industriedienstleistungen based in Porta Westfalica: the creditors’ assembly has approved the investor solution negotiated by insolvency administrator Dr André Wehner. Tempton Personaldienstleistungen GmbH will manage the business going forward. All 12 jobs have therefore been saved and the Porta Westfalica office will be maintained. Tempton has also already made its first investments at the location.

SUNTEC, which has specialised in placing skilled workers in the technical sector since its foundation more than 20 years ago, filed for insolvency due to declining sales. On 1 October 2023, the Local Court of Bielefeld then appointed Dr André Wehner from PLUTA Rechtsanwalts GmbH as insolvency administrator. He had previously acted as provisional administrator for the company. The PLUTA attorney stated, “Temporary employment agencies have been disproportionately affected by insolvency in recent months. For relatively small personnel providers in particular, it is increasingly difficult to find workers. This was also why this agency filed for insolvency.”

Business continuation a challenge

Ever since the provisional insolvency proceedings were ordered in mid-August, Dr Wehner has kept the business operating together with the managing director. He has been supported during the proceedings by his colleague business lawyer Mr Tim Austmeyer.

“It has proven challenging to keep the business operating. We had no liquidity at the beginning and could not place any of our agency workers for two weeks because customers had themselves switched to short-time working or were closed due to renovations. This makes it all the more pleasing that we have now been able to achieve a good solution for the employees,” said the insolvency administrator.
