STRENESSE AG has had a successful start to the new 2014/2015 financial year. For the first time in many months, the fashion company now has achieved positive results. “In July and August we were in the black,” says Michael Pluta, Chief Restructuring Officer. The new financial year began for STRENESSE AG on 1 July.

Insolvency administrator Frank Mößle from PLUTA Rechtsanwalts GmbH has sold the business operations of the insolvent Biogas Westerwald GmbH & Co. KG from Ettinghausen in Germany to ABO Kraft & Wärme Ettinghausen GmbH & Co. KG. Following many rounds of negotiations with investors from the energy industry, Mößle has now succeeded in selling business operations as part of the restructuring programme. The parties agreed not to disclose any details concerning the purchase price.

Insolvency administrator Mirko Möllen from PLUTA Rechtsanwalts GmbH has ensured that business operations at the insolvent company EUROPATENT Gesellschaft für europäischen Patentdienst GmbH + Co. OHG will continue. “Business is good, the customers have stayed loyal to us,” said Möllen. The company is continuing to execute orders and is taking on new orders.

After the successful completion of the restructuring process, the insolvency administrator Michael Pluta from PLUTA Rechtsanwalts GmbH managed to sell the business operations of YTAB Industrielackierungen GmbH following insolvency. The buyer is Autotest Iggingen GmbH, a newly founded subsidiary of Autotest AG based in Lana, South Tyrol. This automotive supplier in the premium brand sector is thus expanding its business, while continuing to go along the path to growth.

In his function as insolvency administrator, Stephan Ammann from PLUTA Rechtsanwalts GmbH was able to sell the entire real estate portfolio of the residential property company BGP Immo-West, despite insolvency. By the summer of 2012, the Local Court of Munich had opened insolvency proceedings concerning the assets of BGP Immo-West S.à.r.l. & Co. KG. At this time, the company had owned a portfolio of roughly 2,400 residential and commercial units.

The clinic companies “KOL Klinikum Osnabrück Land GmbH” and “SKOL Service Klinikum Osnabrücker Land GmbH” filed a request for debtor-in-possession management with the Osnabrück Local Court. The court approved the requests and has opened the so-called preliminary proceedings. Last week, the supervisory board also appointed Torsten Gutmann, who is an reorganisation expert and attorney at PLUTA Rechtsanwalts GmbH, as a further managing director of the two companies. He is expected to support the reorganisation process and contribute his expertise to the process of debtor-in-possession management.

In cooperation with the German business daily “Handelsblatt”, the American specialist publisher “Best Lawyers” honoured three attorneys from PLUTA as “Germany's Best Attorneys 2014”.

In the insolvency proceedings concerning the assets of Andreas Tress, the owner of KEP Transporte, Mr. Florian Zistler, attorney-at-law at the law firm PLUTA Rechtsanwalts GmbH, was able to make a distribution to the creditors from the insolvency estate. The sum disbursed is in the medium six-digit range and corresponds to an insolvency quota of 31.8 %.

S + T Sicherheit und Technik GmbH & Co. KG filed for the opening of insolvency proceedings concerning its assets at Bremen Local Court. By decision of 1 July 2014, the court ordered temporary insolvency proceedings and appointed the attorney Dr. Christian Kaufmann as the temporary insolvency administrator of the company and the limited liability company that acts as its general partner.

PLUTA Rechtsanwalts GmbH has opened its first office in Eastern Europe. The new office is in the Polish town of Ostrów Wielkopolski, which is in the triangle formed by the cities of Posen, Lodz and Breslau. When choosing the location, mainly its strategic position for a series of manufacturing companies in the region was decisive. The new office is already managing its own cases in Poland. At the same time, offering a bridgehead to Eastern Europe allows closer coordination of the proceedings of German companies with subsidiaries in Poland.

On 26 June 2014, Sachsendruck Plauen GmbH, an OAN Group company, filed for the opening of insolvency proceedings to be conducted under a self-administered insolvency plan. By decision of 2 July 2014, the court temporarily ordered management of the company by a debtor-in-possession and appointed Mr. Michael Schoor, attorney and tax consultant at PLUTA Rechtsanwalts GmbH, as the temporary custodian. The company’s management will be supported by Mr. Rüdiger Bauch, an attorney at the practice Schultze & Braun.

In his function as insolvency administrator, Mr. Stephan Ammann from PLUTA Rechtsanwalts GmbH sold Solarschmiede GmbH as a result of management buyouts. The two business units, Engineering and Software, will be integrated into HaWe Engineering GmbH and Solarschmiede Software GmbH respectively. The new companies will be headed by Felix Schneider and Rudi Haas, the business units’ previous directors.
