The C.F. Maier Group, with more than 1,000 employees in Europe and the U.S., is repositioning itself for the future. The name C.F. Maier stands for high-quality services and products in two independent business areas: plastics engineering and aluminium casting. The plastics division, which has a workforce of more than 850 people worldwide, was able to hold its position even in the difficult COVID-19 year 2020. Sales revenues and profit in this business segment developed even better than planned. The casting division at the Königsbronn and Nersingen-Straß sites, which has been in deficit for years, has started a restructuring process. The aim is to put the significantly smaller division with around 120 employees on an independent footing so that it can be sold or restructured under a restructuring plan.

Mr Florian Schiller from PLUTA Rechtsanwalts GmbH has found an investor for Bock GmbH & Co. KG, based in Lauterbach in the federal state of Baden-Württemberg. The insolvency administrator of the injection moulding manufacturer sold the business operations to Plastium GmbH from Schiltach with effect from 1 January 2021. The purchase agreement was signed today. The parties involved have agreed not to disclose any details concerning the purchase price. Despite the challenging economic situation and the difficult general conditions due to the coronavirus pandemic, the insolvency administrator has thus secured around 40 jobs.

Diedrich Meyer GmbH & Co. KG, a forwarding company based in Bremen, has filed for insolvency. Following this, on 14 December 2020, the Local Court of Bremen ordered provisional insolvency proceedings and appointed Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH as provisional administrator.

Creditors have unanimously approved the insolvency plan for ZIM Flugsitz GmbH during a meeting held in the Bodenseeforum events centre in Constance. The restructuring process for the aircraft seat manufacturer has thus been completed. All jobs at the company’s main site in Markdorf have been saved, while, as announced in September, the production site in Schwerin has been downsized.

Mr Christian Heim from PLUTA Rechtsanwalts GmbH has announced the conclusion of the insolvency proceedings for K-Promotion Produktions- und Veranstaltungs GmbH. The attorney distributed a dividend of 53% to the creditors of the Kiel-based concert organiser. Dividends in such insolvency proceedings are generally in the single figures.

A new operator is set to run the bus service in the Oberes Gäu area from the start of next year. The district of Böblingen, with the involvement of the districts of Calw and Tübingen, has agreed to the change of operator on “route bundle 11”, as the present bus company Verkehrsbetriebe Nagoldtal (VBN) based in Nagold is no longer in a position to continue operating the service. VBN is part of the Rexer Group. Mr Ilkin Bananyarli from PLUTA Rechtsanwalts GmbH has been acting as insolvency administrator for the Group since summer 2019.

GHBV (Gesamthafenbetriebsverein im Lande Bremen e.V.), the personnel service provider for the twin ports of Bremen/Bremerhaven, known as the Ports of Bremen, has filed an application for the opening of debtor-in-possession insolvency proceedings. In this context, Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH has been appointed chief restructuring officer. He will be responsible for the restructuring process together with administrative staff overseen by managing director Mr Klaus Rommel and the PLUTA team in Bremen, comprising Mr Jürgen Schendel, Mr Soeren Eckhoff and Mr André Gildehaus. The Local Court of Bremen approved the application for debtor-in-possession proceedings and appointed Mr Edgar Grönda from Schultze & Braun, an experienced attorney based in Bremen, as provisional insolvency monitor.

On 4 December 2020, the Local Court of Weilheim ordered provisional debtor-in-possession proceedings to be opened for EMT Ingenieurgesellschaft Dipl.-Ing. Hartmut Euer mbH’s assets, as requested, and appointed Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor. Dr Oliver Liersch from law firm Brinkmann.Weinkauf will support the company during the restructuring process as general agent.

Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH is looking for an investor for Bremen-based software firm bremacon GmbH. The company specialises in solutions for the energy industry.

A decisive obstacle has been overcome in the process of restructuring Hittech Prontor GmbH based in Bad Wildbad: the insolvency plan presented by the company has been unanimously approved by the creditors’ assembly and subsequently confirmed by the Local Court of Tübingen. “Today’s approval by creditors means that we have made a decisive step towards achieving the goal we set ourselves for the debtor-in-possession proceedings, namely to keep Hittech Prontor’s business running, sustainably restructure the company and put it back on a solid footing in order to secure its future,” said Mr Volker Kiefer, managing director of Hittech Prontor GmbH.
“Termination of the proceedings as the last step in this process is expected to take place at the turn of the year 2020/2021,” he added.

Good news for creditors of the insolvent Richard Frank GmbH: restructuring expert Mr Michael Pluta from PLUTA Rechtsanwalts GmbH can distribute almost a million euros among them. The recovery rate will be 84%, an above-average amount.

On 10 November 2020, the Local Court of Aurich ordered provisional insolvency proceedings to be opened for the assets of Lottmann GmbH & Co. KG. The court appointed Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for the forwarder from Aurich in Lower Saxony.

An investor was found for long-standing company Christian Senning Verpackungsmaschinen GmbH & Co. KG from Bremen: it has been part of the Optima Group based in Schwäbisch Hall since October 2020. This acquisition allows Optima to expand its product range. Dr Christian Kaufmann and his team from PLUTA Rechtsanwalts GmbH advised management at Senning during the debtor-in-possession proceedings.

Safet Ljajka, the operator of the CCS-Gastronomie and Paulaner Wirtshaus am Markt restaurants, has filed for insolvency. Following this, on 3 November 2020, the Local Court of Aalen ordered provisional insolvency proceedings and appointed Mr Steffen Beck from PLUTA Rechtsanwalts GmbH as provisional administrator. Ljajka operates several renowned restaurants at the Congress Centrum Stadtgarten venue under the CCS-Gastronomie banner and another at the Bud Spencer pool, all in Schwäbisch Gmünd. He also operates the well-known Wirtshaus am Marktplatz restaurant in the town’s market square. All of the restaurants’ operations are currently suspended on account of the coronavirus pandemic.

The Aachen-based Haugg Group has successfully completed its restructuring first began in 2016 with the third protective shield proceedings for its subsidiaries in the south of Germany. Insolvency monitor Mr Michael Pluta from PLUTA Rechtsanwalts GmbH oversaw the proceedings and also represented creditors’ interests.

Bäumler Fashion GmbH has filed for insolvency proceedings to be opened for its assets. On 8 October 2020, the Local Court of Ingolstadt ordered provisional insolvency proceedings and appointed Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH as provisional administrator. The fashion house based in Ingolstadt has had to file for insolvency due to liquidity problems as it has recently seen significant declines in sales due to the COVID-19 pandemic.

Mr Michael Bremen from PLUTA Rechtsanwalts GmbH has started the process of finding an investor for Tidal Operations Germany GmbH (TOG). TOG operates ten hotels under the Holiday Inn, Holiday Inn Express and Crowne Plaza brands in major German cities. The creditors’ committee has already approved the continued operation of the hotels.

The RPM Rüster Group filed an application for the opening of insolvency proceedings on 1 October 2020. Following this, the Local Court of Göppingen ordered provisional insolvency proceedings and appointed Mr Fritz Zanker from PLUTA Rechtsanwalts GmbH as provisional administrator for Rüster Präzisionstechnik GmbH & Co. KG.

Provisional insolvency administrator Mr Ingo Thurm from PLUTA Rechtsanwalts GmbH has launched a process to find an investor for Teccom Pharma based in Sarstedt, near Hanover.

Dr Marc Cezanne, in his capacity as Managing Director of Flughafen Paderborn/Lippstadt GmbH, today filed an application with the Local Court of Paderborn for the opening of debtor-in-possession insolvency proceedings. This means that the company’s restructuring concept, which has been drawn up in recent months and will create the basis for the local airport’s future, is now set to be implemented. Mr Stefan Meyer from PLUTA has been appointed provisional insolvency monitor.

ZSK GmbH has filed an application for the opening of debtor-in-possession insolvency proceedings. The Local Court of Ravensburg ordered provisional proceedings to be opened on 31 August 2020. Restructuring expert Mr Michael Pluta from PLUTA Rechtsanwalts GmbH has been appointed to oversee the proceedings and represent creditors’ interests as provisional insolvency monitor.

ZIM Flugsitz GmbH, which has been engaged in debtor-in-possession proceedings since July 2020, is to commence negotiations on a restructuring concept that envisages the retention of both the Markdorf and Schwerin sites. However, the site in Schwerin would then specialise in the areas of service, maintenance, pre-development and development support. Repairs and on-site services would still be offered to customers. 20 employees would work at the Schwerin site in the future. For those employees that could not be kept on, the company will act swiftly to conduct negotiations with the works council with the aim of agreeing solutions designed to mitigate the impact. The goal is to conclude a balance of interests agreement and social plan by October. A total of 68 people are currently employed at the Schwerin site.

Ambiance Fitness GmbH, which already runs the Ambiance Sports & Spa in Pasing, has taken over the tenancy of the insolvent Cardio Fitness Center GmbH. The new operator’s plans mean that there will be a high-quality fitness studio in Starnberg from the end of the year.

The day before yesterday, the creditors of ‘Job Find 4 You Personalmanagement’ from Gronau unanimously approved the restructuring plan submitted by its management team to the competent local court in Münster. The local court subsequently confirmed the plan which had been drawn up by the company’s management team and the restructuring officer, attorney Mr Markus Freitag from the law firm AndresPartner, in consultation with the court-appointed insolvency monitor, attorney Mr Stefan Meyer from the law firm PLUTA Rechtsanwalts GmbH.

Mr Ilkin Bananyarli from PLUTA Rechtsanwalts GmbH, insolvency administrator for the Rexer Group, has recorded another success in the proceedings for the Baden-Württemberg bus company. Effective 1 August 2020, Omnibus-Verkehr Ruoff GmbH (OVR) from Waiblingen will take over the bus service in the Heilbronn district. All 22 employees will be kept on and the present connections will be seamlessly continued with the existing buses.

Following the conclusion of a comprehensive company acquisition agreement back in mid-July 2020, all closing conditions have now been met and the sale can proceed. Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH, the insolvency administrator appointed by the Local Court of Bielefeld, has thus succeeded in finding an investor for Karl W. Niemann GmbH & Co. KG based in Hedem in Preußisch Oldendorf.

Effective 1 August 2020, publisher Funke Mediengruppe will take over the operations of the distribution company in Osterode. The Alfeld site will also be sold to an investor from Hanover on 1 August 2020. The parties involved have agreed not to disclose the purchase price. The agreements reached mean that all jobs have thereby been saved.

Krankenhaus 14 Nothelfer, a Weingarten hospital, is to be restructured under debtor-in-possession insolvency proceedings. The necessary application was filed with the Local Court of Ravensburg on 28 July 2020 due to imminent illiquidity. The court ordered provisional debtor-in-possession proceedings and appointed Mr Michael Pluta from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor.

Diakonische Altenhilfe der Region Hildesheim gGmbH, a company providing diaconal elderly care in the Hildesheim region, is set to exit debtor-in-possession insolvency proceedings after just seven weeks. The Local Court of Hildesheim will soon terminate the proceedings now that the creditors have approved an insolvency plan presented by the company on 21 July 2020. The Steinberg facility and 330 jobs within the Leine-Innerste diaconal association have been saved.

A follow-up solution has been achieved for the G-fashion Group in spite of earlier store closures during the coronavirus pandemic. Effective 1 July 2020, an investment company has acquired two of the clothing retailer’s stores in Munich as well as the group’s headquarters in Bindlach

The court has ordered the provisional proceedings to be opened and appointed attorney Mr Martin Mucha from law firm GRUB BRUGGER as provisional insolvency monitor. Management at the aircraft seat manufacturer based in Markdorf, in the Federal State of Baden-Württemberg, will be supported by experts Mr Jochen Glück and Dr Maximilian Pluta from the PLUTA restructuring company.

Iron foundry Eisengießerei Torgelow GmbH will restructure itself under debtor-in-possession proceedings. Management today filed a corresponding application with the Local Court of Neubrandenburg, which has already been approved by the court. Mr Sebastian Laboga from PLUTA Rechtsanwalts GmbH has been appointed provisional insolvency monitor.

Restructuring expert Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH has succeeded in finding an investor for Niemann Formholztechnik GmbH & Co. KG based in Preußisch Oldendorf. The furniture manufacturer has been bought by Emotion Warenhandels GmbH in Bremen. Effective 1 July 2020, the company has acquired the business and has kept on all of the 25 current employees. The production facility at the Preußisch Oldendorf site will be retained. The parties have agreed not to disclose the purchase price.

Insolvency administrator Mr Christian Heim from PLUTA Rechtsanwalts GmbH has achieved an excellent outcome for creditors of an insolvent company within the Driver & Bengsch Group. They received an 81.9% recovery rate in the insolvency proceedings of Viktoria Immobilien GmbH.

Mr Georg Jakob Stemshorn from PLUTA Rechtsanwalts GmbH has achieved a follow-up solution for Schwab Förder- und Lagertechnik GmbH based in Oettingen. SÜDSTAHL GmbH & Co. KG will take over the business operations of the long-established Bavarian company by way of an asset deal. The contract was signed with effect from 10 June. The parties involved have agreed not to disclose the purchase price.

In spite of the current challenging situation, an investor has been found for Heinrich Kütemeyer Baugeschäft GmbH based in Hanover. Effective 1 June 2020, the business operations have been sold under an asset deal to Franke Bauunternehmen GmbH from Sarstedt, near Hanover. All staff have been kept on and managing director Mr Markus Pfeffermann will also remain on board. The Heinrich Kütemeyer construction company has been involved in provisional debtor-in-possession proceedings since March 2020.

The management board of Vapiano SE, in consultation with insolvency administrator Dr Ruth Rigol from PLUTA Rechtsanwalts GmbH, has succeeded in finding an investor for the Vapiano restaurant chain in Germany. At the same time, the Local Court of Cologne opened insolvency proceedings for Vapiano SE with effect from 1 June 2020 and appointed Dr Ruth Rigol as insolvency administrator.

fc retail GmbH filed an application for the opening of insolvency proceedings on 29 May 2020. Following this, the Local Court of Münster ordered provisional insolvency proceedings and appointed Dr Ria Brüninghoff from PLUTA Rechtsanwalts GmbH as provisional administrator. The company runs a long-established fashion emporium in Ibbenbüren in the German state of Westphalia.

The future of e-cigarette reseller Hello Vape has been secured. All of the company’s current 16 stores throughout Germany will continue operating and the jobs will be retained. Insolvency administrator Mr Sebastian Laboga, a restructuring expert from PLUTA Rechtsanwalts GmbH, has been able to transfer the business to a strategic investor with effect from 16 May 2020. The investor has chosen to remain anonymous.

The coronavirus pandemic has dealt a particularly severe blow to the trade fair and event industry. Effective 1 May 2020, a medium-sized investor from the region has taken over the trade fair service provider’s business operations and its 37 employees.

The Ludwigsburg-based publisher specialising in technical magazines had to file for insolvency in February 2020 due to liquidity problems. Effective 1 May 2020, specialist publisher TeDo Verlag GmbH from Marburg has taken over business operations.

The management board of Vapiano SE, together with provisional insolvency administrator Dr Ruth Rigol, decided today to commence a sales process which may also extend to the global business, restaurant portfolio or assets of the Vapiano Group. The sales process with interested investors is planned to run until the end of May 2020, and will not include the franchise restaurants (especially in Germany).

Mr Volker Kiefer, Managing Director of Hittech Prontor GmbH in Bad Wildbad, is looking to restructure the long-established company through debtor-in-possession proceedings and put it back on a competitive footing.

Gustav Knippschild GmbH and Sander Maschinenbau GmbH & Co. KG took a decisive step forward today. The creditors’ assemblies of both companies unanimously approved the insolvency plans designed to secure the existence of both companies. Managing directors Mr Andreas Eder and Mr Dirk Vogt thanked the creditors at the meetings for their trust. Such a key part of the restructuring process could not have been implemented within such a short time without the support of employees and their representatives, the main bank involved and also suppliers and customers. The companies will further improve production processes and distribution channels on this basis. Dr Rainer Eckert from law firm Eckert Rechtsanwälte is the insolvency monitor for both debtor-in-possession proceedings.

Mr Alexander Klein, managing director of Langenhagen-based NORD-EXPRESS Transport GmbH, has filed an application to open debtor-in-possession insolvency proceedings with the competent Local Court of Hanover. Dr Georg Heidemann of Stellmach & Bröckers, a law firm specialising in corporate restructuring, is assisting management in his capacity as general agent. Attorney and business management expert Mr Torsten Gutmann from PLUTA has been appointed provisional insolvency monitor.

On 1 April 2020, the Local Court of Rottweil opened insolvency proceedings for Bock GmbH & Co. KG from Lauterbach. Mr Florian Schiller from PLUTA Rechtsanwalts GmbH was appointed insolvency administrator. He had previously acted as provisional administrator for the company. Insolvency proceedings for the assets of sister company Weisser Werkzeugbau GmbH & Co. KG from Deißlingen were also opened on the same day. Creditors of the insolvent care and therapy centre in Bayerisch Gmain last week unanimously approved the insolvency plan presented by the company. The Local Court of Traunstein then confirmed this plan. The company has been involved in debtor-in-possession insolvency proceedings since late 2017. Mr Mirko Möllen from PLUTA Rechtsanwalts GmbH, as insolvency monitor, has been monitoring the proceedings and representing the interests of creditors.

Restructuring expert Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH is the provisional insolvency administrator of Strandlust GmbH & Co. KG. The Local Court of Bremen ordered provisional proceedings on 2 April 2020 and appointed the experienced attorney as provisional administrator. The company operates the well-known Strandlust hotel, located directly on the River Weser in the Vegesack district in the north of Bremen.

Insolvency administrator Ms Heike Metzger from PLUTA Rechtsanwalts GmbH is currently holding promising discussions with a potential investor for hms easy stretch GmbH based in Heilbronn. A non-binding memorandum of understanding has already been signed. The details still need to be negotiated in the weeks ahead. On 1 April 2020, the Local Court of Heilbronn opened insolvency proceedings for the company’s assets and appointed attorney Ms Heike Metzger as insolvency administrator. She had already been involved as provisional administrator.

The management board of Vapiano SE has filed for insolvency with the Local Court of Cologne. The court has appointed Dr Ruth Rigol of PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for the restaurant chain. Dr Rigol and the PLUTA team have begun their work and are in the process of gaining an initial overview of the situation with the support of the management board and consultants.

By an order of 1 April 2020, the Local Court of Charlottenburg has appointed Mr Sebastian Laboga from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for Sitzfeldt GmbH. The online retailer of designer sofas and premium seating furniture has had to file for insolvency due to a significant decline in sales as a result of the ongoing COVID-19 crisis. It had to close its showrooms across Germany two weeks ago. Sales via its online store have also been suspended at this time. This has led to the failure of a planned funding round.

On 30 March 2020, Seelig + Co. Feinblechbau GmbH decided to file for debtor-in-possession proceedings under section 270a of the German Insolvency Code (InsO). Effective yesterday, 1 June, those proceedings have now been opened. “Based on the expert report from insolvency monitor Mr Michael Pluta, the court has thereby confirmed that our company is not only capable but also worthy of restructuring,” emphasised managing directors Ms Sabine Bieber and Mr Thomas Seelig. Feinblechbau GmbH based in Neresheim, Germany, has entered provisional debtor-in-possession proceedings pursuant to section 270a of the German Insolvency Code (InsO). The family business had already embarked upon a rigorous restructuring at the start of the year, but the flagging economic situation in recent times has now necessitated the next step. Seelig + Co. Feinblechbau GmbH will be able to use the debtor-in-possession proceedings to completely restructure itself under its own steam, while maintaining business operations. The long-established company will be assisted in this by external specialists: restructuring experts from Planer & Kollegen GmbH based in Landsberg am Lech will oversee the debtor-in-possession proceedings and support the management team during the entire restructuring process. The local court has appointed Mr Michael Pluta from PLUTA Rechtsanwalts GmbH as provisional insolvency monitor. He will monitor the proceedings while representing the interests of creditors.

Mr Sebastian Hrabak, owner of Schwarze Kiste e.K., has had to file for insolvency. On 11 March 2020, the Local Court of Augsburg ordered provisional insolvency proceedings and appointed Mr Georg Stemshorn from PLUTA Rechtsanwalts GmbH as provisional administrator.

Karl W. Niemann GmbH & Co. KG based in Preußisch Oldendorf, a well-known supplier to the furniture industry, filed for insolvency last week. On 6 March 2020, the Local Court of Bielefeld ordered provisional insolvency proceedings to be opened for the company’s assets and appointed restructuring expert Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH as provisional administrator. The company’s subsidiary Niemann Formholztechnik GmbH & Co. KG is also involved in provisional insolvency proceedings. Mr Stefan Meyer has been appointed provisional administrator for this company as well.

The Leysieffer chocolate business, based in Osnabrück but well known throughout Germany, has a future. Restructuring experts attorney Mr Joachim Walterscheid, the company’s advisor on insolvency matters during the debtor-in-possession proceedings, and attorney Mr Stefan Meyer, insolvency monitor, have succeeded in restructuring the company within twelve months and securing 260 jobs.

Hello Vape, a retail chain for e-cigarettes and associated equipment, had to file for insolvency on 20 February 2020 after a partner unexpectedly refused to provide funds to finance the company’s growth. The Local Court of Charlottenburg has appointed Mr Sebastian Laboga from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for the company.

Insolvency administrator Mr Michael Schoor from PLUTA Rechtsanwalts GmbH has fully satisfied the claims of all creditors of wood specialist EVG Holzhandwerk Leipzig eG. These are insolvency claims pursuant to section 38 of the German Insolvency Code (InsO).

Provisional insolvency administrator Mr Florian Schiller from PLUTA Rechtsanwalts GmbH has launched a process to find an investor for Bock GmbH & Co. KG, based in Lauterbach. In parallel, discussions are ongoing regarding Bock’s sister company Weisser Werkzeugbau GmbH & Co. KG, based in Deißlingen in the state of Baden-Württemberg. PLUTA restructuring expert Mr Steffen Beck is involved as provisional administrator in the insolvency proceedings for Weisser.

By an order of 19 February 2020, the Local Court of Straubing appointed Mr Daniel Barth from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for MicroPyros GmbH. The company specialising in renewable energy had to file for insolvency due to liquidity problems. A planned funding round could not be completed.

By an order issued on 18 February 2020, the Local Court of Frankfurt am Main has appointed Mr Frank Mößle from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for AWO Protect gGmbH. The company had to file for insolvency in early February 2020. The managing director had already suspended business operations and terminated the contracts of all six remaining employees effective 29 February and 31 March 2020. Filing for insolvency became inevitable for the company due to liquidity problems, as the security firm had no further orders.

RP Vertriebsgesellschaft GmbH from Erkelenz, a company that is well known in the motor sport and tuning scene under the brand names ‘IronForce’ and ‘Ring Police’, filed for insolvency with the Local Court of Mönchengladbach on 10 February 2020 on account of a liquidity shortfall. Following this, the insolvency court ordered measures to preserve the company’s assets and appointed Mr Michael Bremen, an attorney from PLUTA Rechtsanwalts GmbH, as provisional insolvency administrator on the same day.

LiveCycle GmbH is continuing its restructuring measures as planned under debtor-in-possession insolvency proceedings. The company initiated a structured process of finding an investor yesterday. “We have already held initial talks with interested parties, which have been very promising. Our aim is to achieve a long-term solution for LiveCycle by this spring,” said Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH.

The Local Court of Kempten opened insolvency proceedings for Grüntenlifte Betriebs-GmbH yesterday and appointed Mr Florian Zistler from PLUTA Rechtsanwalts GmbH as administrator. Mr Zistler had already been involved in this matter as provisional administrator since November 2017.

In November 2019, Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH began the process of finding an investor for the metal construction company HIK Systeme und Module. This has now been completed. The restructuring expert and his team have achieved a long-term solution for the operation in Rahden. HIK GmbH (a subsidiary of GLA-WEL GmbH based in Melle) have taken over the business operations under an asset deal.

A long-term solution has been found for Schmid Solution GmbH & Co. KG based in Ditzingen near Stuttgart. Mr Steffen Beck from PLUTA Rechtsanwalts GmbH sold the business to Pascal Schmid with effect from 1 February 2020.

The Local Court of Bückeburg opened insolvency proceedings for the assets of Gustav Knippschild GmbH and Sander Maschinenbau GmbH & Co. KG as planned on 1 February 2020. Both proceedings will continue to be pursued under debtor-in-possession management.

LiveCycle GmbH filed an application for the opening of debtor-in-possession insolvency proceedings. Following this, the Local Court of Munich ordered provisional proceedings to be opened. The company had to file the application after the lack of bridging funds had led to a liquidity shortfall. The innovative bicycle service provider, headquartered in Munich, will use the options offered by the proceedings to reposition itself and to accelerate the previously started process of finding an investor.

Insolvency administrator Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH sold the business operations of PEACOCK Moden GmbH to the newly founded DaLe Vertriebs GmbH. The purchase agreement has been signed by the persons responsible this week with effect from 1 April 2020.

Mr Florian Zistler from PLUTA Rechtsanwalts GmbH has now also succeeded in finding a buyer for the second location of the passenger carrier service Taxi Allgäu. Ms Julie Krüger from Lengenwang in the Allgäu region has been operating the business since 1 February 2020. She has already signed the purchase agreement and has kept on all six members of staff. This means that passenger and medical transport services in the region will also be ensured in future. Mr Zistler had held talks with several parties interested in buying the Füssen location, with the contract finally being awarded to Ms Krüger.

Mr Patrick Meyerle from PLUTA Rechtsanwalts GmbH has succeeded in finding a long-term solution for FG-Elektronik GmbH based in Rückersdorf near Nuremberg. SASSE Elektronik GmbH took over the company as part of an asset deal with effect from 28 January 2020. The persons responsible for the transaction have agreed to maintain confidentiality about the purchase price

Leysieffer GmbH & Co. KG has taken an important step in securing the company’s future during debtor-in-possession proceedings. The process of finding an investor has been successfully concluded.

To be able to continue its restructuring programme, Job Find 4 You Personalmanagement GmbH yesterday filed an application with the Local Court of Münster for the opening of debtor-in-possession insolvency proceedings. The court has assented to this application and ordered provisional debtor-in-possession proceedings. As a result of the court order, the management of the business will remain in the hands of the management board. Business operations will continue without restriction and all customers will continue to be professionally looked after.

Mr Michael Pluta has succeeded in achieving a solution for the language school ifa Akademie. The restructuring expert and managing director of PLUTA Rechtsanwalts GmbH sold the business to the renowned educational organization Kolping-Bildungswerk Württemberg with effect from 1 January 2020. In future, well-trained professionals will continue to provide high-quality language courses under the umbrella of the Kolping-Bildungswerk.

Bock GmbH & Co. KG, based in Lauterbach, and its sister company Weisser Werkzeugbau GmbH & Co. KG, located in Deißlingen in the federal state of Baden-Württemberg, have filed for insolvency. The Local Court of Rottweil ordered provisional insolvency proceedings to be opened for the assets of both companies on 24 January 2020.

The Local Court of Weilheim has appointed Mr Mirko Möllen from PLUTA Rechtsanwalts GmbH as provisional insolvency administrator for Dorfladen Wörthsee UG. The company had to file for insolvency on 19 December 2019. The managing directors have already closed the company and terminated all nine employees effective 31 December 2019 or 15 January 2020.

The Bremen-based and Hagen-im-Bremischen-based operational companies in the FORNY Group filed applications with the competent insolvency courts in Bremen and Cuxhaven for the opening of insolvency proceedings for their assets on 30 December 2019. In concrete terms, this affects FORNY Group GmbH, EFORNY Services GmbH, OFORNY Professionals GmbH, FORNY Global Professionals GmbH and IFORNY Joint Ventures UG (limited).

Mr Markus Küthe of Kluth Rechtsanwälte, Chief Restructuring Officer in the debtor-in-possession proceedings, has concluded a purchase agreement with Kaufland for the Dormacenter shopping centre in Dormagen on behalf of REII - Development AG, the centre’s insolvent owner and operator.

Now it is official: the Local Court of Dessau has terminated the debtor-in-possession proceedings for the vehicle producer Meier-Ratio GmbH based in Dessau-Roßlau. This means that the management team has successfully completed the restructuring process implemented on its own initiative.

The start of the new year also heralds a new beginning for the GERRY WEBER Group. With effect from 31 December 2019, the Local Court of Bielefeld ordered the termination of the debtor-in-possession insolvency proceedings for GERRY WEBER International AG (GWI), which had been opened on 1 April of that year. Thanks to these proceedings, it had taken the fashion company less than one year to successfully implement a concept for the future.
