Following the decision taken today, the Local Court of Bielefeld has appointed the attorney Dr Stephan Thiemann from PLUTA Rechtsanwalts GmbH as the insolvency administrator of Brüggershemke + Reinkemeier KG. Previously, Dr Thiemann had acted as the provisional insolvency administrator of the company.

GEWA 5 to 1 GmbH & Co. KG has filed for insolvency. Following the decision taken on 21 November, the Local Court of Esslingen has appointed Ilkin Bananyarli from PLUTA Rechtsanwalts GmbH as the provisional insolvency administrator.

The insolvency administrator Mr Mirko Möllen from PLUTA Rechtsanwalts GmbH successfully completed the process of finding an investor for the shipping company Hans Peter Dusch GmbH Transporte und Spedition.

ggp Electronics GmbH successfully commenced business operations in October. The insolvency administrator Torsten Gutmann from PLUTA Rechtsanwalts GmbH, explained: “Technologically high-quality circuit boards will also be manufactured in Germany in the future.”

Following today’s decision, the Local Court of Memmingen has opened ordinary insolvency proceedings for the assets of the buying and selling cooperative E.V.G – Ein- und Verkaufsgenossenschaft eG Erkheim. The court has appointed Dr. Thomas Karg from the Memmingen law firm Dr. Karg Puhlmann & Kollegen, who has until now acted as the insolvency monitor, as the insolvency administrator.

The creditors of Haugg Industriekühler GmbH from Sulz am Neckar have unanimously approved the insolvency plan for restructuring the company at the creditors’ assembly called by the competent local court of Rottweil. The court had already accepted the plan previous to this.

Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH succeeded in selling the business of the insolvent packaging company Securitas Gesellschaft für Seeverpackung mbH & Co. KG with effect from 1 October. The buyer is the newly founded company GFS Seeverpackung mbH & Co. KG. Of the previous 24 members of staff, 23 will be kept on by the buyer. This means that Dr Kaufmann succeeded in finding a feasible long-term solution for the traditional enterprise, which was founded in 1962, within just four weeks. The Local Court of Bremen had appointed the restructuring expert as the provisional administrator on 5 September and, by decision of 1 October, as the final insolvency administrator. The company had to file for insolvency due to a decrease in orders and intensified competition in the special transport packaging sector

The insolvency administrator Mr Stefan Kahnt from PLUTA Rechtsanwalts GmbH has succeeded in finding an investor for the bakery Gellertstadt Bäckerei GmbH. After maintaining business operations for three months, he sold the business to Ralf Groschupf GmbH, a bakery and confectionary with roots in the region, with effect from 1 October 2016. The corresponding contract has already been signed.

Following the decision taken today, the Local Court of Bielefeld has appointed Dr Stephan Thiemann from PLUTA Rechtsanwalts GmbH as the provisional insolvency administrator of Brüggershemke + Reinkemeier KG.

Teuto-Glasveredelung GmbH (in Augustdorf) and Teuto-Glas GmbH & Co. KG (in Bad Bentheim) have filed applications for debtor-in-possession proceedings with the Local Court of Detmold. The Local Court has assented to these applications and ordered preliminary debtor-in-possession proceedings. The attorney Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH was appointed as the provisional insolvency monitor in both proceedings.

With its decision of 5 September, the Local Court of Bremen appointed the restructuring expert Dr Kaufmann from PLUTA Rechtsanwalts GmbH as the provisional insolvency administrator of the packaging and logistics company Securitas Gesellschaft für Seeverpackung mbH & Co. KG.

Ein- und Verkaufsgenossenschaft eG filed for debtor-in-possession proceedings with the Local Court of Memmingen two days ago. This step became inevitable due to a cash shortage.

The restructuring experts from CONSABIS GmbH and PLUTA Rechtsanwalts GmbH have found a long-term solution for pbp Preissinger GmbH & Co. KG together with the company’s management team. With effect from 16 August 2016, TEFELEN GmbH took over the business operations, which means that the company is being restructured by way of an asset transfer. All the jobs are saved. Business operations will be continued without any interruptions. The intention is to retain “Preissinger” in the company’s future name.

DECON Verbundstoff GmbH & Co. KG based in Horstmar filed for the opening of insolvency proceedings on 8 August 2016. With an order issued on 11 August 2016, the Local Court of Münster appointed Mr Stefan Meyer, a restructuring expert and attorney at PLUTA Rechtsanwalts GmbH, as the provisional insolvency administrator.

Insolvency administrator Mr Torsten Gutmann from PLUTA Rechtsanwalts GmbH has succeeded in finding an investor for ggp Schaltungen GmbH. After having maintained business operations for seven months, he has now sold the company to the American investor AIAC. The committee of creditors has already consented to this sale. The transaction will be completed in September when the business will be taken over by the newly founded ggp Electronics GmbH, which, however, is subject to approval by the German Federal Cartel Office. This means that 100 jobs will be saved.

The restructuring expert Mr Stefan Kahnt from PLUTA Rechtsanwalts GmbH is currently in the process of finding an investor for the bakery Gellertstadt Bäckerei GmbH. He has already received initial offers from several potential investors. Negotiations will take place in the next few days or weeks to ensure that a long-term solution for the traditional bakery will be found in the near future.

In spite of intensive efforts being made, it has not been possible to find an investor for the Wadersloh-based company PASCHEN GmbH. The reason for this is the withdrawal by a financing partner at short notice. PASCHEN GmbH is therefore now obliged to cease business operations in the coming weeks. The 96 employees were informed of the closure during a staff meeting.

PLUTA Abogados y Administradores Concursales, S.L.P. was appointed by Commercial Court No. 6 in Madrid as the insolvency administrator of the Grupo Inmobiliario Alvi Corp, S.L. and two of their subsidiaries in June.

Insolvency administrator Mr Ingo Thurm from PLUTA Rechtsanwalts GmbH has sold the business of Wiegand Automobile GmbH from Bad Salzdetfurth. Feddersen Automobile Service GmbH will take over the business operations of the used car dealer with effect from 1 August 2016. This means that the jobs of 27 employees, including four trainees, have been saved.

pbp Preissinger GmbH & Co. KG can continue their restructuring process as planned as part of the debtor-in-possession proceedings. The Local Court of Bamberg confirmed the company’s application for debtor-in-possession proceedings from April and opened the main proceedings on 1 July 2016. The company, which was founded in 1985, is a specialist in and a one-stop provider of busbar systems. The customer base includes major industry groups in Europe, America and Asia.

The insolvency administrator Mr Michael Pluta from PLUTA Rechtsanwalts GmbH has sold the assets of the laundry service Tetkov to the newly founded company Wäscherei Oberschwaben GmbH with effect from 1 July 2016. All 28 employees were kept on by the new owner.

In spite of difficult conditions, insolvency administrator Mr Mirko Möllen from PLUTA Rechtsanwalts GmbH has succeeded in selling the tank storage facility belonging to Viktoriagruppe AG in Krailling. The buyer is the newly founded Krailling Oils Development GmbH based in Pullach. The parties have agreed to maintain confidentiality on the purchase price. The purchase contract includes a time-limited right to withdraw, thus enabling the insolvency administrator to achieve even better terms under certain circumstances.

Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH has succeeded in finding a long-term solution for the project management company GABO:mi Gesellschaft für Ablauforganisation :milliarium mbH & Co. KG. With effect from 1 July 2016, the French enterprise ARTTIC S.A.S. took over the company, which means that GABO:mi will be restructured by way of an asset transfer. Since the investor is a competitor, this solution will mean that synergies can be realised. All the 21 jobs will be saved as a result of the takeover.

Following the decision taken on 1 July 2016, the competent local courts have opened insolvency proceedings as planned for the companies in the Hock Group. The insolvency administrators are continuing the full scope of business activities performed by the six operational Hock companies and see good prospects for the supplier of parts to the car and electrical industries. At the same time, the restructuring experts Michael Pluta, Dr Stephan Thiemann, Stephan Ammann and Florian Schiller from the law firm PLUTA Rechtsanwalts GmbH together with Dr Jan Markus Plathner from Brinkmann & Partner are continuing to restructure the Hock companies and are currently holding promising talks with prospective investors. The insolvency administrators have commissioned the hww team set up around the expert Burkhard Jung to coordinate the M&A process. The insolvency administrators are aiming to achieve a long-term solution for all the companies and employees.

Following the decision taken on 20 June 2016, the Local Court of Chemnitz appointed Mr Stefan Kahnt from PLUTA Rechtsanwalts GmbH as the provisional insolvency administrator for Gellertstadt Bäckerei GmbH.

Following the decision taken on 1 June 2016, the Local Court of Dessau-Roßlau has opened insolvency proceedings for the assets of the operator of the Dessolino Indoor Playing Field. The court appointed the restructuring expect Dr Stephan Thiemann from PLUTA Rechtsanwalts GmbH as the insolvency administrator.

The cardboard manufacturer Feinpappenwerk Gebr. Schuster GmbH & Co. KG has to close business operations by 31 August 2016. The 115 employees were informed of the closure yesterday afternoon during a staff meeting. With its decision of 31 May 2016, the Local Court of Munich had opened the insolvency proceedings and appointed Mr Stephan Ammann from PLUTA Rechtsanwalts GmbH as the insolvency administrator. The company had filed for insolvency in April of this year. Since then, the attorney Mr Ammann has been the provisional insolvency administrator of the company, which is also known under the name “SCHUSTER-Karton”.

The insolvency administrator Holger Christian Buehler from PLUTA Rechtsanwalts GmbH has achieved a long-term solution for the Galerie Hotel at the truckstop in Himmelkron. The buyer of the hereditary building right to the building is Euro Rastpark GmbH & Co. KG from Regensburg, the company which took over the neighbouring truckstop just one year earlier. Prior to the sale, there were extensive negotiations with several investors. The parties have agreed to maintain confidentiality on the purchase price.

The company PASCHEN GmbH based in Wadersloh filed an application for debtor-in-possession proceedings with the Local Court of Münster last Thursday, which was subsequently approved by the court. The experienced insolvency and restructuring attorneys Dr Ruth Rigol and Dr Stefan Homann from the law firm Dr Ringstmeier & Kollegen will advise and lead the company through the restructuring proceedings. Furthermore, the insolvency court has appointed Mr Stefan Meyer from PLUTA Rechtsanwalts GmbH in Münster, a restructuring expert and attorney for insolvency law, as the provisional insolvency monitor.

The restructuring experts Torsten Gutmann and Ingo Thurm from PLUTA Rechtsanwalts GmbH have succeeded in finding an investor for the insolvent HASTRABAU-WEGENER GmbH & Co. KG from Langenhagen. The Gross Construction Group, based in St. Ingbert in Saarland, will take over the Hanover site. The acquisition will take the form of restructuring by way of an asset transfer. This means more than 80 jobs, 10 of which are for trainees, will be saved. The company will keep its traditional name “HASTRABAU” and its headquarters in the current location. The current head of the Technical Department, Mr Ibrahim Sencan (Graduate Engineer), together with his team will continue to be responsible for customers throughout Germany, both in the private and public sector. The new company will in future be named HASTRABAU GmbH & Co. KG.

Dressel + Höfner GmbH & Co. KG has taken delivery of a new injection moulding machine from the manufacturer Krauss-Maffei. The machine was installed directly after delivery and now makes it possible to process different materials needed for one component at the same time. Moreover, it is capable of producing heavier parts and uses the latest generation of software, which allows even more precise injection moulding. The machine is used to manufacture such car parts as door panels and centre consoles. Purchasing the machine was the company’s reaction to an increase in demand. The company already has a large number of orders requiring the use of the machine.

Nolte-Möbel GmbH & Co. KG filed an application with the Local Court of Paderborn for the opening of insolvency proceedings as debtor in possession on 10 May 2016. These debtor-in-possession proceedings are aimed at taking advantage of the opportunity offered to turn around the company on a long-term basis and are characterised by the fact that the company’s senior staff will keep their positions and be fully capable of taking action. There will be no insolvency administrator, but simply an insolvency monitor, who will observe and oversee the proceedings. The Local Court of Paderborn appointed the PLUTA attorney Mr Stefan Meyer as the provisional insolvency monitor at Nolte-Möbel GmbH & Co. KG.

Following the decision taken on 3 May 2016, the Local Court of Kempten has opened insolvency proceedings for the assets of Ritter & Kyburz GbR that manages the property located at Bahnhofstrasse / August-Fischer-Platz in Kempten. The court has appointed the restructuring expert Mr Florian Zistler from PLUTA Rechtsanwalts GmbH as the insolvency administrator. The insolvency of Ritter & Kyburz GbR is related to a project for the construction of commercial premises at August-Fischer-Platz in Kempten.

The Hock Group filed an application for insolvency for eight of their companies. The supplier of the car and electrical industry has approximately 900 employees working at five sites in Germany and at one site in Romania.

The company pbp Preissinger GmbH & Co. KG filed for debtor-in-possession proceedings with the Local Court of Bamberg yesterday. The reason for this step is structural problems in distribution as well as non-payment by a major customer in 2015.

With its decision of 1 April 2016, the Local Court of Munich appointed Mr. Stephan Ammann from PLUTA Rechtsanwalts GmbH as the provisional insolvency administrator of the cardboard manufacturer Feinpappenwerk Gebr. Schuster GmbH & Co. KG.

Mr Frank Mößle from PLUTA Rechtsanwalts GmbH has sold the assets of DeSisti Lighting GmbH to an investor with effect from 31 March 2016. At the end of July 2015, the Local Court of Mainz had opened insolvency proceedings based on the company’s application for insolvency following the unexpected death of their managing director at that time.

The drop forging company Suhler Gesenkschmiede und Bearbeitungswerk GmbH was sold to Ralf Welt, a successful entrepreneur from the Ostalb district, on 15 March. All of the 23 members of staff were kept on by the new owner, and the company’s name will also be preserved. The parties have agreed to maintain confidentiality on the purchase price.

The restructuring expert Torsten Gutmann from PLUTA Rechtsanwalts GmbH achieved the optimal solution for the future of the insolvent company CTS Logistik Personal Service GmbH from Göttingen. The relevant meeting for discussion and voting in the debtor-in-possession proceedings was already held in January. All the groups of creditors agreed to the insolvency plan drafted, and in the meantime it has already come into effect.

The construction services provider HASTRABAU-WEGENER GmbH & Co. KG filed for insolvency with the Local Court of Hanover. By decision of 19 February 2016, the court ordered provisional insolvency proceedings. The 190 employees have already been informed on the insolvency, and the pre-financing of the so-called insolvency substitute benefits has also been arranged. Thanks to these insolvency substitute benefits, employee salaries are secure for a period of up to three months.

Insolvency administrator Dr. Martin Prager from PLUTA Rechtsanwalts GmbH has fully satisfied the claims of all the creditors of TACO Kunststofftechnik GmbH. These claims are all the regular insolvency claims pursuant to section 38 of the German Insolvency Code (Insolvenzordnung - InsO).

According to Torsten Gutmann from PLUTA Rechtsanwalts GmbH, creditors can expect a two-figure recovery rate in the insolvency proceedings for the assets of Tiziano Gelati Braunschweig GmbH, meaning that they will receive an above-average payment on their claims. The PLUTA restructuring expert provided information on this at the meeting of creditors. It was possible to save all the 70 jobs as part of the insolvency proceedings.

Mr Georg Stemshorn from PLUTA Rechtsanwalts GmbH is planning comprehensive restructuring measures for the traditional bakery Vögele. In order to ensure that the bakery has good future prospects, a number of outlets will have to be closed. The two branches in Schwabmünchen and the Untermeitingen branch will continue to operate. These measures should ensure that 16 of the original 53 jobs will be saved on a long-term basis.

Insolvency administrator Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH has achieved an investor solution for Straubinger Metallbau GmbH. The acquisition took the form of restructuring by way of an asset transfer with effect as of today. The company’s name will be preserved. It has been agreed that the purchase price will not be published. 18 employees will be kept on.
