Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH succeeded in selling the business of the insolvent packaging company Securitas Gesellschaft für Seeverpackung mbH & Co. KG with effect from 1 October. The buyer is the newly founded company GFS Seeverpackung mbH & Co. KG. Of the previous 24 members of staff, 23 will be kept on by the buyer. This means that Dr Kaufmann succeeded in finding a feasible long-term solution for the traditional enterprise, which was founded in 1962, within just four weeks. The Local Court of Bremen had appointed the restructuring expert as the provisional administrator on 5 September and, by decision of 1 October, as the final insolvency administrator. The company had to file for insolvency due to a decrease in orders and intensified competition in the special transport packaging sector

Insolvency administrator Mr Torsten Gutmann from PLUTA Rechtsanwalts GmbH has succeeded in finding an investor for ggp Schaltungen GmbH. After having maintained business operations for seven months, he has now sold the company to the American investor AIAC. The committee of creditors has already consented to this sale. The transaction will be completed in September when the business will be taken over by the newly founded ggp Electronics GmbH, which, however, is subject to approval by the German Federal Cartel Office. This means that 100 jobs will be saved.

Not possible to find an Investor for PASCHEN

In spite of intensive efforts being made, it has not been possible to find an investor for the Wadersloh-based company PASCHEN GmbH. The reason for this is the withdrawal by a financing partner at short notice. PASCHEN GmbH is therefore now obliged to cease business operations in the coming weeks. The 96 employees were informed of the closure during a staff meeting.

Restructuring Experts see good Future Prospects for the Hock Group

Following the decision taken on 1 July 2016, the competent local courts have opened insolvency proceedings as planned for the companies in the Hock Group. The insolvency administrators are continuing the full scope of business activities performed by the six operational Hock companies and see good prospects for the supplier of parts to the car and electrical industries. The cardboard manufacturer Feinpappenwerk Gebr. Schuster GmbH & Co. KG has to close business operations by 31 August 2016. The 115 employees were informed of the closure yesterday afternoon during a staff meeting. With its decision of 31 May 2016, the Local Court of Munich had opened the insolvency proceedings and appointed Mr Stephan Ammann from PLUTA Rechtsanwalts GmbH as the insolvency administrator. The company had filed for insolvency in April of this year. Since then, the attorney Mr Ammann has been the provisional insolvency administrator of the company, which is also known under the name “SCHUSTER-Karton”.

Gross Construction Group based in St. Ingbert takes over the insolvent Company HASTRABAU-WEGENER

The restructuring experts Torsten Gutmann and Ingo Thurm from PLUTA Rechtsanwalts GmbH have succeeded in finding an investor for the insolvent HASTRABAU-WEGENER GmbH & Co. KG from Langenhagen. The Gross Construction Group, based in St. Ingbert in Saarland, will take over the Hanover site. The acquisition will take the form of restructuring by way of an asset transfer. This means more than 80 jobs, 10 of which are for trainees, will be saved. The company will keep its traditional name “HASTRABAU” and its headquarters in the current location. The current head of the Technical Department, Mr Ibrahim Sencan (Graduate Engineer), together with his team will continue to be responsible for customers throughout Germany, both in the private and public sector. The new company will in future be named HASTRABAU GmbH & Co. KG.

New Injection Moulding Machine for Dressel + Höfner – Business Operations will be continued

Dressel + Höfner GmbH & Co. KG has taken delivery of a new injection moulding machine from the manufacturer Krauss-Maffei. The machine was installed directly after delivery and now makes it possible to process different materials needed for one component at the same time. Moreover, it is capable of producing heavier parts and uses the latest generation of software, which allows even more precise injection moulding. The machine is used to manufacture such car parts as door panels and centre consoles. Purchasing the machine was the company’s reaction to an increase in demand. The company already has a large number of orders requiring the use of the machine.

Nolte-Möbel GmbH & Co. KG filed an application with the Local Court of Paderborn for the opening of insolvency proceedings as debtor in possession on 10 May 2016. These debtor-in-possession proceedings are aimed at taking advantage of the opportunity offered to turn around the company on a long-term basis and are characterised by the fact that the company’s senior staff will keep their positions and be fully capable of taking action. There will be no insolvency administrator, but simply an insolvency monitor, who will observe and oversee the proceedings. The Local Court of Paderborn appointed the PLUTA attorney Mr Stefan Meyer as the provisional insolvency monitor at Nolte-Möbel GmbH & Co. KG.

Insolvency administrator Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH has achieved an investor solution for Straubinger Metallbau GmbH. The acquisition took the form of restructuring by way of an asset transfer with effect as of today. The company’s name will be preserved. It has been agreed that the purchase price will not be published. 18 employees will be kept on.
