PLUTA restructuring expert Peter Roeger achieves follow-up solution for cleaning company MIR

5 October 2021 · Würzburg · Business Area Insolvency Administration

Mr Peter Roeger from PLUTA Rechtsanwalts GmbH has found an investor for the industrial cleaning company MIR Gebäudereinigung und Dienstleistungen GmbH from Schwebheim, near Würzburg. The insolvency administrator has sold the business to a buyer within the family that controls the company as part of an asset deal, effective 1 October 2021. The new owner will keep on all current 88 employees within a newly founded company that is called ‘MIR Gebäudereinigung und Service’; this will take over the business operations as a sole proprietorship.

“This welcome outcome has been made possible by the good cooperation during the proceedings. I would like to express my sincere gratitude to all involved for this. Due to new orders that we have won, we have even hired additional people since the application for insolvency was filed. I would also especially like to thank the Schweinfurt branch of the Federal Employment Agency, which has provided us with pragmatic, straightforward assistance in these proceedings,” said attorney Mr Roeger. He is being supported in the proceedings by business lawyer Mr Holger Ch. Buehler. As an experienced PLUTA restructuring expert, Mr Buehler has helped to keep the business operational and assisted in the process of finding an investor.

Discussions with several potential investors

Since the application was filed in summer 2021, the business has remained fully operational while observing the appropriate hygiene requirements. Also in summer 2021, PLUTA restructuring expert Mr Roeger and his experienced team launched the process of finding an investor for the family business and held discussions with several interested parties. The aim was to find a sustainable solution that would ensure the company’s survival. “We held several discussions with potential investors. The solution now achieved represents the best possible outcome for the company, employees and creditors,” added the attorney.

Ms Berivan Akbulut, managing director of MIR Gebäudereinigung und Service, stated, “We will continue to add to the lengthy history of this family-run business. With our industrial cleaning services and customer base, we are very well positioned for the future.”

The origins of MIR Gebäudereinigung und Dienstleistungen GmbH go back to 1992. The family business, based in Schwebheim in the Schweinfurt district of Lower Franconia, specialises in industrial cleaning, but also offers caretaking services.

The company filed for insolvency in summer 2021. On 21 July 2021, the Local Court of Schweinfurt ordered provisional insolvency proceedings to be opened for the assets of MIR Gebäudereinigung und Dienstleistungen GmbH and appointed Mr Peter Roeger as provisional administrator. On 1 October 2021, the proceedings were opened and the restructuring expert was appointed insolvency administrator.

Mr Peter Roeger is an attorney specialising in insolvency law and has extensive experience in restructuring crisis-stricken companies. He has acted as an insolvency administrator for several years and supports corporate restructurings under debtor-in-possession proceedings. In spring 2021, for example, he achieved a follow-up solution for mechanical engineering company Stefan Plätzer from Bamberg.
