Insolvency administrator Mr Frank Mößle from PLUTA Rechtsanwalts GmbH has succeeded in finding an investor solution for K-lar GmbH, having kept the company operational for months. Almost all of the employees working for the social media agency based in Hesse will be kept on. This means that the PLUTA team has achieved the best possible outcome in the proceedings.
The social media agency has been involved in insolvency proceedings since this summer. On 1 October 2023, the Local Court of Offenbach am Main opened insolvency proceedings for the assets of K-lar GmbH and appointed Mr Frank Mößle as administrator. He had previously acted as provisional administrator for the company, which he had kept fully operational.
Klar Agentur GmbH, a newly founded company, has acquired the business by way of an asset deal effective 1 November 2023. The new company’s shareholders include the employees and the managing director.
K-lar GmbH had had to file for insolvency due to liquidity problems, as sales had declined since the COVID-19 crisis and budgets had been cut. The agency’s well-known clients were still supported during the proceedings and could avail themselves of all services. The business continued operating without restrictions even after the proceedings were opened. The company’s highly qualified staff were supportive of the efforts to keep it operating and played a key role in the positive outcome.
Restructuring expert Mr Mößle, a business management expert, tax consultant, auditor and one of the managing directors of PLUTA Rechtsanwalts GmbH, said, “We have held numerous discussions with all involved in recent months. The follow-up solution now achieved is the best possible outcome for the business. Almost all jobs have been saved.”
