Dr Christian Kaufmann from PLUTA Rechtsanwalts GmbH has launched the process to find an investor for DUHA Fertigteilbau GmbH based in Haselünne in the Emsland region. The company specialises in the manufacture of precast concrete elements.
On 7 October 2021, the Local Court of Meppen ordered provisional insolvency proceedings and appointed Dr Kaufmann as provisional administrator. The company had to file for insolvency due to liquidity problems associated with quarantine measures mandated following a number of positive COVID-19 cases and the resulting production stoppage, which lasted several weeks.
The family business has continued operating without restrictions since the application was filed and orders are still being processed. The salaries of the some 80 employees are guaranteed for a period of three months thanks to specific substitute benefits provided under German insolvency law. The PLUTA team analysed the company’s financial situation in recent days and has now launched the process of finding an investor, which will be supported by experts under Mr Hamed Omumi from WAYES GmbH & Co. KG in Oldenburg.
Significant investor interest
PLUTA restructuring expert Dr Kaufmann said, “Investors are already showing keen interest. We are receiving new queries on a daily basis. I am therefore confident that we will find a sustainable solution for this family business in the near future. DUHA Fertigteilbau GmbH has modern manufacturing facilities, and its staff are highly motivated and skilled. This is a great basis.” The administrator expects to receive the first non-binding offers by early November, followed by binding offers from potential investors by mid-November.
The insolvency administrator is aiming to conclude the investor process by the end of the year and save the company’s jobs. He is being supported in his team by attorney Mr André Gildehaus, business lawyer Ms Sunny-Jo Linderkamp and economist Mr Jürgen Schendel.
DUHA Fertigteilbau GmbH was founded in 1971. The company has extensive know-how in the manufacture of precast construction elements made of reinforced and prestressed concrete, such as roof trusses, walers, beams, supports, prefabricated concrete ceilings and double and thermal walls. Staff also manufacture special parts such as filter nozzle plates, products made from high-performance concrete, protective walls, cladding parts with inlaid clinker, and coloured and structured façade elements. Furthermore, DUHA offers comprehensive planning, design, verification of stability and assembly services. Back in 1996, DUHA was one of the first manufacturers of precast concrete elements in Lower Saxony to be granted DIN EN ISO 9001 certification.
